Mandatory Drug And Alcohol Testing

MANDATORY DRUG AND ALCOHOL TESTING

In compliance with the United States Department of Transportation (49 CFR Part 40), employees
of the District performing a safety sensitive job or holding a CDL license will be required to
submit to drug and alcohol tests in accordance with the Rules and Regulations promulgated by
that department.

The testing will be done by a qualified company selected by the District. The agency will review
all mandatory drug testing including pre-employment, random, post accident, reasonable
suspicion and return-to-duty. A laboratory certified by the Department of Health and Human
Services will perform testing in compliance with the Department of Transportation regulations on
the urine samples delivered to them.

Random alcohol testing of employees will be conducted at an annual rate of 25% of safety
sensitive positions and will be performed on National Highway Traffic Safety Administration
(NHTSA) approved evidential breath testing device.

Random drug testing of employees will be done at an annual rate of 50% of the safety sensitive
positions. Employee numbers will be drawn from a general pool to which the District belongs
with a number of other statewide employers. Arrangements will be made with the selected
agency so that these employees will go directly for a urine test when their number is drawn. The
test site facility will be informed of the names to be expected.

The employee will be required to submit to a reasonable suspicion drug and/or alcohol test if
their supervisor suspects drug and/or alcohol use. Behaviors believed to be a result of drug
and/or alcohol use must be observed directly by the supervisor.

A medical review officer (MRO) will review any employee test that is positive from the Center to
determine if the test is confirmed positive. The MRO will refer all employees who have a
confirmed positive test for drugs to a substance abuse professional (SAP). The breath alcohol
technician (BAT) will refer any employee to a SAP whose breath test is 0.04 or above.
Department of Transportation (DOT) regulations outline procedures dealing with employees who
test 0.02 to 0.039. The employee must fulfill the SAP requirements and follow up testing in order
to continue in their safety sensitive position. The employee is responsible for the charges
associated with SAP, drug/alcohol treatment and follow up testing.

Any employee who tests positive, meaning a concentration level of 0.02 or greater, will be
subject to a second confirmation test. If the second test is also positive, the employee will be
terminated from employment with the District.

The use, possession, sale or transfer of illegal drugs, on or off the job, will be cause for
termination. Refusal to participate in a drug screen or alcohol testing, whether selected
randomly or for cause, will result in immediate termination.

All files on drug and alcohol testing are maintained by the Center. This information is strictly
confidential. The District will be advised immediately if an employee fails the drug or tests above
0.02 on breath alcohol measurement and by mail for all negative tests.

School Bus Safety Program

SCHOOL BUS SAFETY PROGRAM

The safety and welfare of student riders will be the first consideration in all matters pertaining to
transportation. Safety precautions will include the following:
1. Students will be instructed as to the proper procedure for boarding and exiting from a school
bus and in appropriate and safe conduct while aboard.
2. Emergency evacuation drills will be conducted at least two times a year, October through
May, to acquaint student riders with procedures in emergency situations.
3. All vehicles used to transport children will be inspected on a regular schedule to see that they
meet safety regulations.
4. All drivers will be screened before employment for physical condition, proper license, and
experience. The prior driving record of each driver will be checked for drug and alcohol or
other convictions and a criminal records check must also be completed.
5. The Board authorizes use of video and/or audio surveillance on school buses to
ensure the health, welfare, and safety of all students while riding on school buses. Use of
such surveillance will be in accordance with Policy ECAF, Audio and Video Surveillance on
School Buses.

The transportation provider will comply with all state and federal laws and regulations pertaining to
the operation of school buses and will make these requirements known to bus drivers. It will also
cooperate with local safety officials in formulating and accomplishing its school bus safety program.

Video Recording On School Property

VIDEO RECORDING ON SCHOOL PROPERTY

The Auburn School Board authorizes the use of video recording devices on District property to
ensure the health, welfare, and safety of all staff, students and visitors to District property and to
safeguard District buildings, grounds, and equipment. The Superintendent will approve
appropriate locations for recording devices. Placement of the video cameras will be based on the
presumption and belief that students, staff and visitors have no reasonable expectation of privacy
in areas or at events that occur in plain view. However, such devices are not to be placed in
bathrooms or locker rooms.

All persons will be responsible for any violations of school rules recorded by cameras.

Videos containing evidence of a violation of student conduct rules, school board policy, and/or
state or federal law will be retained until the issue of the misconduct is no longer subject to
review or appeal, as determined by board policy or applicable law. Any release or viewing of the
video will be in accordance with the law.

In the event a recording from a video recording device contains evidence of wrongdoing, be it a
crime or violation of school conduct policies that could result in discipline, the actual, original
recording will be pulled from service and not re-used or recorded over for a period of not less
than 3 years following the incident in question. Should the recording be confiscated by
prosecutorial authorities as evidence in a crime, the District will take all steps possible to arrange
for a certified copy to be retained by the District.

The Principal will notify staff, students, and parents through handbooks or by other means that
video recording may occur on District property. A notice will also be posted at the main entrance
of all school district buildings indicating the use of video recording.

The District may choose to make recordings part of a student’s educational record or a staff
member’s personnel record. If a video recording does become part of a student’s education
record, the provision of Policy JRA shall apply. The Superintendent is authorized to contact the
District’s attorney for a full legal opinion relative in the event of such an occurrence. The District
will comply with all applicable state and federal laws related to record maintenance and
retention.

Video and audio recordings may be used for special education or Section 504 purposes, when a
student’s individualized education program or accommodation plan includes audio or video
recording as part of the child’s education. All such recordings will be maintained in accordance
with the Family Education Rights and Privacy Act, 20 U.S.C. section 1232g, and other applicable
law(s).

The school board authorizes the Superintendent to use video recordings to the extent allowed by
law.

The school board permits the video and audio recording of the following school-related activities.
This list may be expanded or contracted.

  • Extracurricular/co-curricular activities
  • Musical performances, band, concert band, ensemble, choir
  • Drama activities
  • Club events
  • Sporting events, including both inter and intra-scholastic
  • Other activities such as student council, yearbook, or school pride
  • Ceremonies, orientation, presentations, school assemblies or meetings, or any school
    events which occur outside of the physical classroom

Student Transportation Services

STUDENT TRANSPORTATION SERVICES

The Auburn School District shall provide transportation for pupils to schools in the school district
consistent with provisions of RSA 189:6, 189:9, 189.9a provided they live one mile or more from the
school.

Per RSA 193:12, students who are deemed legal residents of the school district pursuant to a divorce
decree or parenting plan developed under RSA 461-A will not necessarily be provided transportation. The
Superintendent or designee will make all determinations as to whether transportation will be provided in
such circumstances. The Superintendent or designee’s decision will be final.

The following policies shall apply:

General Operating Policy

Pupils who attend charter public schools or approved public schools in the district will be provided
transportation in accordance with RSA 189:9 and RSA 194-B:2,V.

Bus stops shall be established under the direction of the Superintendent and/or designee. Drivers may
not load or unload pupils at unauthorized bus stops.

Student Conduct on School Buses

The bus driver will have responsibility to maintain orderly behavior of students on school buses and will
report misconduct to the student’s Principal in writing. Video cameras may be used on buses to support
the bus driver’s reports of unacceptable conduct. The school Principal will have the authority delegated
by the Superintendent and/or designee to suspend the riding privileges of students who are disciplinary
problems on the bus by failing to conform to the rules and regulations promulgated by the School Board.
Parents of children whose pattern of behavior and conduct on school buses endangers the health, safety
and welfare of other riders will be notified that their children face the loss of school bus riding privileges
in accordance with the student discipline code. Suspensions in excess of twenty consecutive days must
be ratified by the Board (RSA 189:9a).

Resolution of Conflicts

A parent who wishes to request a change or exemption from any of the student transportation policies
shall direct that request to either the school Principal or the Superintendent or his/her designee.

Matters of student conduct should be referred to the Principal while routing and scheduling should be
directed to the Superintendent or his/her designee. Should the parent not be satisfied with the results,
an appeal can be made to the School Board’s Transportation Committee. If the individual remains
dissatisfied, the individual may request an appeal to the Auburn School Board through the
Superintendent.

Audio And Video Recording On School Buses

AUDIO AND VIDEO RECORDING ON SCHOOL BUSES

Video cameras will be used on school buses to monitor student behavior. Audio recordings in
conjunction with video recordings may also be captured on school buses, in accordance with the
provisions of RSA 570-A:2(k)(1).

Notification of such recordings is hereby established in this policy and in Policy JICK – Pupil Safety
and Violence Prevention. The bus company will ensure that there is a sign prominently displayed
on the school buses informing the occupants of the school buses that such video and audio
recordings are occurring.

All recordings shall be retained for a period not to exceed ten (10) days, unless the
Superintendent determines that the recording is relevant to a disciplinary proceeding.

Recordings may be viewed only by the following persons and only after expressly authorized by
the Superintendent:
– Superintendent or designee
– Business Administrator
– Building Administrator
– Law Enforcement Officers
– Transportation Contractor Official

No other individuals shall be entitled to view or listen to the recording without the express
authorization of the Superintendent.

Buildings And Grounds Security

BUILDINGS AND GROUNDS SECURITY

The Board encourages and requires close cooperation with local police and fire departments and
with insurance company inspectors. In order to insure the safest environment for our students
and staff, the school building’s security system is to be armed during all extended, non-user time
in accordance with policy ASD: KG, Community Use of School Facilities.

During school time, security procedures will insure that unauthorized persons will not have access
to the building. Visitors and individuals not employed by the school district will be required to
sign in and out, state the purpose of the visit, and to be identified as visitors during their time in
the building.

The Principal will be responsible for developing and enforcing building security procedures.

School Closings

SCHOOL CLOSINGS

The Superintendent and/or designee is empowered to close the school or to dismiss students
early in the event of hazardous weather or other emergencies which threaten the health or safety
of students and personnel. Students, parents, and staff shall be informed early in each school
year of the procedures which will be used to notify them in case of emergency closing, whether
action is taken before or during school hours.

False Alarms, Bomb, Active Shooter, And Other Such Threats

FALSE ALARMS, BOMB, ACTIVE SHOOTER, AND OTHER SUCH THREATS

The Board recognizes that false alarms, bomb, active shooter or other such violent threats are a
significant concern to the schools. Threats, whether real or a hoax, represent a potential
danger to the safety and welfare of students, staff, and school property.

Making such threats or false alarms will be deemed a violation of the applicable code of conduct,
with potential disciplinary action, and will be referred to law enforcement for potential criminal
prosecution.

Any threat will be regarded as a serious matter and will be treated accordingly. In the event a
threat is made, the following procedures shall be followed:

1. Law Enforcement authorities shall be notified immediately.

2. Simultaneously, the Superintendent shall be notified. The Superintendent or his/her
designee shall make a determination as to whether an immediate evacuation of
school buildings is required in accordance with the district’s Emergency Operations
Plan.

Any decision to re-enter the school or buildings after an evacuation will be made by
the Superintendent, or designee, and only after such clearance has been given by
the appropriate law enforcement agency.

3. An investigation of the threat should be made by local law enforcement authorities or
applicable state department.

4. The Superintendent or her/his designee will communicate the occurrence of any
threat under this policy to the parents of any students in the affected building,
whether or not a full evacuation occurred in accordance with the district’s Emergency
Operations Plan as soon as deemed appropriate under the circumstances.

Making a threat is a crime. As such, any person found to have made a threat will be subject to
arrest and prosecution according to law. Any student suspected of making a threat will be
reported to law enforcement authorities for investigation and possible prosecution. Apart from
any penalty imposed by law, and without regard to the existence or status of criminal charges, a
student who makes a threat shall be subject to disciplinary action, in accordance with applicable
Board policy.

Fire and Hazard Drills

AUBURN SCHOOL DISTRICT FIRE AND HAZARD DRILLS

Fire and hazard drills will be scheduled by the Principal during the school year. The purpose of fire and hazard drills is to train students and staff to move safely, quickly, and quietly from any location within the building to an assigned area outside.

Records of such drills shall be kept in accordance with the Emergency Response Plan.

Emergency Operations Plan

The Superintendent and/or his/her designee shall ensure that a building Emergency Operations
Plan is developed and is understood by staff, faculty, and students. The Emergency Operations
Plan shall be developed in conjunction with local civic officials.
